The U.K. Advertising Standards Authority (ASA) recently upheld three out of four complaints brought by the Youth Alcohol Advertising Council (YAAC) against Fireball Whiskey distributor Hi Spirits Ltd. over social media advertisements that allegedly promoted excessive drinking. In particular, the complaints focused on Fireball Whiskey’s Facebook page, which, in addition to advertisements depicting young women pouring or consuming alcohol, a young man “lying face down on a bed” and teddy bears branded with the whiskey’s logo, apparently featured (i) “a poster in style of ‘Keep Calm and Carry On’” with the tagline “TAKE A SHOT AND IGNITE THE NITE” and a caption asking users to “Like if you think this is a good plan for the weekend!”; (ii) a status update asking users to submit their “Fireball stories from the weekend” to win “Fireball freebies!”; and (iii) a status update asking students undergoing final exams to “Like this status and…

The U.S. Department of Agriculture’s (USDA’s) Agricultural Marketing Service (AMS) has announced the availability of draft guidance concerning (i) “the classification of materials under USDA organic regulations (7 CFR part 205)” and (ii) “materials for use in organic crop production.” In particular, the first set of guidance “details the procedures and decision trees for classifying the materials used for organic crop production, livestock production, and handling,” while the second set includes “an itemization of allowed natural and synthetic materials and a limited appendix of materials prohibited in organic crop production.” AMS has asked “accredited certifying agents, certified operations, material evaluation programs, and other organic industry stakeholders” to submit comments on these documents through June 3, 2013. The agency will eventually publish the finalized version as part of the National Organic Program’s handbook for certifying agents and certified operations. See Federal Register, April 2, 2013.

According to media sources, German officials have apparently launched an investigation into more than 160 farms accused of flouting the standards governing organic and free-range egg production. Lower Saxony and two other states have apparently announced an ongoing probe into poultry establishments, including 40 organic farms, that allegedly marketed their eggs as organic or free-range while keeping their hens in overcrowded conditions. Those operators found in beach of EU regulations face both fines and up to six months in prison. “If the accusations are found to be true, then we are talking of fraud on a grand scale: fraud against consumers but also fraud against the many organic farmers in Germany who work honestly,” said German Food, Agriculture and Consumer Protection Minister Isle Aigner. “Consumers must be able to rely on the fact that what is written (on the produce) is also in there. The U.S. Department of Agriculture’s Agricultural Marketing Service (AMS) has proposed amending the National List of Allowed and Prohibited Substances to change annotations pertaining to the use of peracetic acid in organic crop production and the use of potassium hydroxide, silicon dioxide and betacarotene extract color in organic handling. Following the recommendation of the National Organic Standards Board, AMS has also proposed removing non-organic annatto extract color from the list of approved substances for organic handling. In particular, AMS has requested comments that (i) “identify any formulated hydrogen peroxide products labeled for agriculture use that contain more than 5% peracetic acid,” and (ii) “describe whether product reformulation will be necessary to comply with the proposed amendment for silicon dioxide at section 205.605(b) and the proposed removal of annatto extract color from section 206.606.” The agency has requested comments on the proposed amendments by March 7, 2013. Organic growers and food safety advocates, including the National Organic Coalition (NOC), have condemned recommendations contained in the final report of the Advisory Committee on Biotechnology and 21st Century Agriculture (AC21), a group appointed by the U.S. Department of Agriculture (USDA) to address transgenic contamination of organic and non-genetically engineered (GE) crops. GE crops make up the majority of corn and soybeans produced in the United States. According to news sources, of particular concern in the report is the recommendation that organic and non-GE conventional farmers pay to self-insure themselves against unwanted GE contamination. In a press release NOC stated that “This proposal allows USDA and the agricultural biotechnology industry to abdicate responsibility for preventing GE contamination while making the victims of GE pollution pay for damages resulting from transgenic contamination.” “The AC21 report takes responsibility for GE contamination prevention out of the hands of USDA and the biotech industry…

The Agricultural Marketing Service of the U.S. Department of Agriculture (USDA) has issued a final rule clarifying that the Organic Foods Production Act of 1990 and its implementing regulations require “periodic residue testing of organically produced agricultural products by accredited certifying agents.” Effective January 1, 2013, the rule also “expands the amount of residue testing of organically produced agricultural products by clarifying that sampling and testing are required on a regular basis [and] requires that certifying agents, on an annual basis, sample and conduct residue testing from a minimum of five percent of the operations that they certify.” See Federal Register, November 9, 2012.

The American Academy of Pediatrics (AAP) has published its first report on organic foods, concluding that it’s more important for children to eat a wide variety of healthy produce than to emphasize an organic diet. According to AAP, research has “convincingly demonstrated” that organic diets can reduce consumer exposure to pesticides and drug-resistant diseases. “However, no well-powered human studies have directly demonstrated health benefits or disease protection as a result of consuming an organic diet,” states the report, which urges pediatricians to discuss the weight of scientific evidence when approached by families interested in consuming organic foods. “What’s most important is that children eat a healthy diet rich in fruits, vegetables, whole grains, and low-fat or fat-free dairy products, whether those are conventional or organic foods. The U.S. Department of Agriculture’s National Organic Program (NOP) has issued an interim rule extending the use of nutrient vitamins and minerals in organic handling while the agency considers a proposal to renew their exemption (use) on the National List of Allowed and Prohibited Substances (National List) for another five years. According to a September 27, 2012, Federal Register notice, the Agricultural Marketing Service (AMS) previously published a proposed rule during its 2012 sunset review that recommended continuing the use of nutrient vitamins and minerals “as ingredients in or on processed products labeled as ‘organic’ or ‘made with organic (specified ingredients or food group(s))’” after their National List exemption expired on October 21, 2012. The proposed rule also sought to correct “an inaccurate cross-reference to U.S. Food and Drug Administration (FDA) regulations in the listing for vitamins and minerals on the National List.” The interim rule will allow handlers and…

The U.S. Department of Agriculture’s National Organic Program (NOP) has issued a final rule permitting the use of synthetic methionine in organic poultry production. Effective October 1, 2012, the final rule reduces the maximum levels of methionine per ton of feed as follows: (i) 2 pounds for laying and broiler chickens, and (ii) 3 pounds for turkeys and all other poultry. The final rule also amends the Chemicals Abstracts Service (CAS) numbers “for the allowable forms of synthetic methionine.” According to NOP, “[m]ethionine is classified as an essential amino acid for poultry because it is needed to maintain viability and must be acquired through the diet… Natural feed sources with a high percentage of methionine include blood meal, fish meal, crab meal, corn gluten meal, alfalfa meal, and sunflower seed meal.” In reviewing the rules governing the use of synthetic methionine, a water-soluble crystalline powder, in organic poultry production, the National…

The Center for Food Safety has issued a paper critical of the draft report prepared by the U.S. Department of Agriculture’s (USDA’s) Advisory Committee on Biotechnology and 21st Century Agriculture (AC21), which was scheduled to meet August 27-28, 2012, to discuss the draft. According to the advocacy organization, USDA “has increasingly strayed from its role as ‘enhanc[er of] economic opportunities for US farmers and ranchers,’ by continuing to allow genetically engineered (GE) seeds, pollen, and plants to contaminate our nation’s farms without restraint.” In particular, the center calls AC21’s “co-existence” approach to organic, conventional and GE farming “a thinly veiled attempt to sanction allowable amounts of GE contamination in food by establishing a universal GE contamination threshold.” The paper contends that compensating conventional and organic farmers whose crops are contaminated by drifting GE pollen will not address the losses sustained when other countries ban all U.S. seed and crop imports. “Even…
