The U.S. Department of Agriculture’s National Organic Program (NOP) has issued a final rule extending the use of methionine in organic poultry production until October 1, 2012. Effective March 15, 2011, the rule amends the National List of Allowed and Prohibited Substances according to the recommendations of the National Organic Standards Board (NOSB), which governs the use of synthetic and non-synthetic substances in organic processing and production. A dietary supplement, methionine “is classified as an essential amino acid because it cannot be biologically produced by poultry and is necessary to maintain vitality.” In 2009, the Methionine Task Force filed a petition requesting a five-year extension on the allowance for synthetic methionine, partly because wholly natural sources of the supplement are not available. The U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (APHIS) has issued an interim rule updating its highly pathogenic avian influenza (HPAI) requirements for importing birds, poultry and hatching eggs. Because APHIS’s previous restrictions applied only to the H5N1 subtype of avian influenza, the new rule extends its purview to include any HPAI subtype, thus barring poultry imports from any country where these subtypes “are considered to exist.” Effective January 24, 2011, the interim rule also prohibits the importation of live poultry and birds that “have been vaccinated for any H5 or H7 subtype,” as well as their hatching eggs, since these imports “may produce false positive test results … during the required 30-day quarantine.” In addition, APHIS has banned live poultry, birds and hatching eggs “that have moved through regions where any HPAI subtype exists.” APHIS has invited comments on the interim rule before March 25, 2011.…

Food & Water Watch recently submitted a citizen petition to the U.S. Department of Agriculture’s (USDA’s) Food Safety and Inspection Service (FSIS) to remove China from the list of eligible processed-poultry exporters to the United States. Using a Freedom of Information Act request, the consumer watchdog claims to have found “serious mistakes” in the USDA approval process that allows the imported chicken. The watchdog asserts that (i) “[i]n its haste to get a final rule announced in time for a visit to the United States by the Chinese President in 2006, USDA missed required steps in the approval process and failed to send the rule to the USDA Office of Civil Rights for review”; (ii) “USDA staff made incorrect public statements that consumers would be able to avoid Chinese poultry imports, despite the fact that country of origin labeling requirements would not apply to processed poultry products”; (iii) “[p]ressure on…

German officials have launched an investigation into an animal feed supplier that allegedly distributed a dioxin-tainted additive to 25 feed manufacturers, who in turn sold products to hundreds of poultry, pork and egg farms in Lower Saxony, North Rhine-Westphalia, Thuringia, Saxony, and Brandenburg. According to media sources, Uetersen-based Harles & Jentzsch GmbH made its additive from mixed fatty acids approved only for industrial use and obtained from a biodiesel company. The Federal Ministry for Food, Agriculture and Consumer Protection (BMELV) has since reported that some additive samples contained 77 times the approved limit for dioxin, an industrial byproduct allegedly linked to cancer, although the agency has not received any health notifications related to consumer products. The revelation has drawn international attention, with South Korea and Slovakia blocking German pork and poultry imports after 136,000 tainted eggs were sold to the Netherlands. The U.S. Department of Agriculture (USDA) has issued a final rule requiring mandatory nutrition labeling on 40 major cuts of single-ingredient, raw meat and poultry products. The Nutrition Labeling and Education Act of 1990 requires nutrition facts labels on most foods regulated by the Food and Drug Administration, but USDA-regulated meat and poultry has been exempt, allowing producers to supply the information on a voluntary basis. Effective January 1, 2012, the rule calls for packages of ground or chopped meat and poultry to feature nutrition fact panels on their labels, and whole, raw cuts of meat and poultry to either include facts panels on their package labels or have them available for consumers at the point-of-purchase. Alleging that Perdue Farms Inc. misleads consumers by labeling its chicken products as “Humanely Raised,” a member of the Humane Society of the United States (HSUS) has reportedly filed a putative class action against the company in a New Jersey court. The suit apparently claims that the company’s chickens are processed under National Chicken Council guidelines that allow “numerous inhumane practices, including painful handling and shackling of live birds . . . and egregiously inhumane slaughter practices.” The plaintiff seeks to represent all consumers who buy the company’s chicken products relying on the “alleged deceptive and misleading humane claim.” Compensatory damages and injunction relief are also sought. According to an HSUS spokesperson, “Rather than implementing humane reforms, Perdue has simply slapped ‘humanely raised’ stickers on its factory farmed products, hoping consumers won’t know the difference.” Perdue reportedly responded to the complaint by stating, “The Humane Society of the United States…

An Ohio poultry facility linked to the latest egg recall over Salmonella-contamination concerns was reportedly the recipient of a $125 million investment by Austin “Jack” DeCoster, the man who owned the two Iowa farms linked to the August 2010 recall of 550 million potentially contaminated eggs. The Ohio Agriculture Department apparently indicated earlier this year that DeCoster was still an investor in Ohio Fresh Eggs. The latest recall involves nearly 300,000 eggs distributed in eight states. While no confirmed illnesses have been linked to the eggs, egg seller Cal-Maine, Inc. reportedly said “consumers who believe they may have purchased potentially affected shell eggs should not eat them.” According to a news source, the Centers for Disease Control and Prevention linked the August outbreak to at least 1,600 illnesses. The United States has reportedly decided not to file an appeal from a World Trade Organization (WTO) ruling that its ban on Chinese poultry imports, imposed in 2004 upon fears of an avian flu outbreak, was illegal. According to a news source, this ends the trade dispute. While the legislative ban expired within five years, under current U.S. law, the U.S. Department of Agriculture cannot allow poultry imports unless the foreign country’s food safety procedures are deemed equivalent to those used in the United States. The U.S. Department of Agriculture’s (USDA’s) Food Safety and Inspection Service (FSIS) has issued draft guidelines for video monitoring at federally inspected meat and poultry plants. Although the guidelines do not require in-plant video monitoring, such practices can be used to help strengthen food safety and humane animal-handling practices, and to monitor product inventory and building security, according to an October 14, 2010, FSIS news release. “Records from video or other electronic monitoring or recording equipment may also be used to meet FSIS’ record-keeping requirements,” the agency stated. The guidelines stem from a 2008 USDA Office of Inspector General (OIG) recommendation that called for FSIS to “determine whether video monitoring would be beneficial in slaughterhouse establishments,” FSIS Administrator Al Almanza was quoted as saying. “In agreeing to that OIG recommendation, FSIS committed to issuing compliance guidelines for using video records and a directive clarifying FSIS’ authority to access establishment video…

Effective October 1, 2010, the interim rule allows organic operations to use synthetic methionine at the following maximum limits per ton of poultry feed: (i) four pounds for laying chickens; (ii) five pounds for broiler chickens; and (iii) six pounds for turkeys and all other poultry. According to an August 24, 2010, press release, the National Organic Standards Board (NOSB) in April 2010 called for amending the National List of Allowed and Prohibited Substances to permit the continued use of synthetic methionine, an amino acid essential for poultry health and development, because its prohibition would “cause substantial economic hardship” for producers.
