A New York federal court has dismissed a putative class action alleging that Mondelez misled consumers by labeling Oreos as "always made with real cocoa" despite containing cocoa refined through an alkalizing process. Harris v. Mondelez Global LLC, No. 19-2249 (E.D.N.Y., entered July 28, 2020). The plaintiffs argued that the "representation 'real cocoa' is false, deceptive and misleading because consumers expect 'real cocoa' to indicate a higher quality cocoa than had the ingredient merely been accurately identified as 'cocoa' (minus the descriptor 'real')." "Plaintiffs do not dispute that the challenged products are in fact made with cocoa, which is fatal to their case," the court held. " Plaintiffs’ claims are trained on whether the product contains cocoa that is real, and the Oreos indisputably do contain cocoa, along with other ingredients." The court dismissed the claims with prejudice, finding the substantive issue could not be cured with better pleadings.

Mondelez International Inc. allegedly markets its Oreos as containing "Real Cocoa" despite containing "cocoa processed with alkali." Harper v. Mondelez Int'l Inc., No. 19-2747 (N.D. Post Consumer Brands LLC allegedly misleads consumers by marketing its Cocoa Pebbles and related products as made with "real cocoa" despite listing only "cocoa (processed with alkali)" in the ingredients panel, according to a consumer's putative class action. Copeland v. Post Consumer Brands LLC, No. 19-2488 (E.D.N.Y., filed April 26, 2019). The complaint asserts that alkali in cocoa affects "the taste and color of the cocoa powder to such an extent that they are a characterizing feature"; further, consumers believing the product to contain "real cocoa" expect "the cocoa powder component to be nutritionally and organoleptically superior than it actually is." For alleged violations of California's consumer-protection statutes as well as negligent misrepresentation, breach of warranties, fraud and unjust enrichment, the plaintiff seeks class certification, injunctive relief, restitution, damages and attorney's fees.
