Danone has reportedly decided not to pursue its applications to the European Food Safety Authority (EFSA) to approve beneficial health claims for two of its yogurt products, Actimel® and Activia®. According to a news source, the company took the action because of changes to European regulation of health claims. Previously, each member state’s regulatory authority decided whether these claims could be made; the U.K.’s Advertising Standards Authority, for example, prohibited an Actimel® TV advertisement in 2009, ruling that evidence did not support company claims that the product could help protect school-age children from illness. Going forward, EFSA will approve advertising health claims, but procedures and criteria to do so are apparently under development. Danone will participate in an EFSA consultation meeting scheduled for June 1, 2010. See BBC News, April 15, 2010.

The European Food Safety Authority (EFSA) has published safety reassessments of three food additives, Brilliant Black (E 151), Brown HT (E 155) and Brown FK (E 154). For Brilliant Black, which first gained approval in 1984, EFSA has confirmed the existing acceptable daily intake (ADI) of 5 milligrams per kilogram of bodyweight (mg/kg bw). According to the scientific panel, Brilliant Black is used in soft drinks, bakery products and desserts, but “only some children who regularly consume large amounts of foods containing the color might exceed this level of intake.” EFSA, however, has recommended decreasing by one-half the ADI for Brown HT, setting the new limit at 1.5 mg/kg bw after “adverse effects, such as slightly reduced weight gain, were noted in animals following long-term exposure” to the additive. A committee of European Union (EU) member state officials has reportedly decided to cease imposing U.S. rice import restrictions which had been in place since 2006 when genetically modified (GM) rice was found in conventional rice supplies. U.S. rice could be sold in the EU over the past four years only if certified as free from GM rice. Rice farmers in the United States have cited the EU restrictions in litigation against the company that manufactured the GM rice; the farmers have prevailed in several lawsuits, winning both compensatory and punitive damages for the precipitous drop in prices paid for their crops after the EU and Japan essentially closed their borders to all U.S. rice. The Liverpool City Council is reportedly considering a ban on the word “obesity” after the Liverpool Schools Parliament, a student body organization, expressed concern that some could find the term offensive. Although some experts have apparently disputed this contention, suggesting that the word adequately reflects the severity of the health condition, students argue that the stigma “would turn people off, particularly young people,” as one youth representative told the press. The proposal would require the council to use the description “unhealthy weight” in all literature geared toward children. “We can’t change government terminology or clinician terminology, but we can look at changing how we communicate weight issues in council reports and in our communications with children,” a council spokesperson was quoted as saying. The Romanian government has reportedly proposed a tax on fast foods high in fat, sugar and salt. Backed by the European Public Health Alliance, the health ministry has sought to create the world’s most comprehensive tax scheme that would include, not just sugary foods and beverages, but savory fare as well. Proponents have claimed that the measure would help combat rising obesity rates in the Balkan nation while simultaneously raising £860 million for government coffers. But legislators have apparently struggled to define fast food as they consider more than 40,000 products eligible for the levy. They have already exempted popular street fare like pizza and kebabs on the ground that these items are often made from fresh ingredients, drawing further criticism from detractors who have questioned the proposal’s uneven application. The European Food Safety Authority’s (EFSA’s) Panel on Food Additives and Nutrient Sources has assessed “the safety of steviol glycosides, sweeteners extracted from plant leaves, and established an Acceptable Daily Intake [ADI] for their safe use.” According to EFSA, toxicological testing showed that the substances, such as stevioside and rebaudioside, “are not genotoxic, nor carcinogenic, or linked to any adverse effects on the reproductive human system or for the developing child.” The panel has set an ADI for steviol glycosides of 4mg per kg body weight per day, a level “consistent” with the joint recommendation of the U.N. Food and Agriculture Organization and World Health Organization. As the panel noted, however, “this ADI could be exceeded by both adults and children if these sweeteners are used at the maximum level proposed by the applicants” seeking authorization to market the sweetener. The Environmental Protection Agency (EPA) recently published an action plan to address concerns over bisphenol A (BPA), which has purportedly “caused reproductive and developmental effects in animal studies and may also affect the endocrine system.” Intended to strengthen the agency’s chemical management program, the plan focuses on the plasticizer’s environmental impact and proposes (i) adding BPA to the chemical concern list; (ii) gathering information on BPA concentrations in surface, ground and drinking water; (iii) requiring manufacturers to provide EPA with test data related to long-term effects on growth, reproduction and development in aquatic organisms and wildlife; (iv) using EPA’s Design for the Environment program to reduce unnecessary exposures and find acceptable substitutes; and (v) continuing to evaluate “the potential disproportionate impact on children and other sub-populations through exposure from non-food packaging uses.” In addition, EPA has pledged to work with the Food and Drug Administration (FDA) and other federal entities to…

The U.K. Food Standards Agency (FSA) Board has reportedly agreed to maintain a confidential database of food industry research into nanotechnology, as well as a public registry of food and food packaging products that contain both approved nanomaterials and materials appearing to have nanoscale elements. “The way that we respond in terms of nanotechnology is a test case for the way we, as a regulator respond, to emerging and new technologies,” FSA Chief Scientist Andrew Wadge was quoted as saying. According to media sources, FSA accepted the recommendations put forth in a House of Lords Science and Technology Committee report, which called on regulators to develop risk assessment procedures and prioritize research into the safety of nanotechnology. In making its assessment, the committee had apparently favored mandatory industry participation, claiming that a lack of transparency had previously led to public distrust of genetically modified crops. The European Parliament’s Committee on Environment, Public Health and Food Safety (ENVI) has apparently issued a legislative report that recommends several changes to EU food labeling laws, but stops short of proposing a uniform “traffic light” system. After considering more than 800 amendments to draft legislation, ENVI approved “minor changes to existing rules on information that is compulsory on all labels, such as name, list of ingredients, ‘best before’ or ‘use by’ date, [and] specific conditions of use.” The committee agreed that all EU foodstuffs should list “key nutritional information” pertaining to energy and fat content, saturated fat, carbohydrates, sugar, salt, protein, fiber, and natural and artificial trans fats. It also favored country-of-origin labeling for “meat, poultry, dairy products, fresh fruit, vegetables, and other single-ingredient products as well as for meat, poultry and fish when used as an ingredient in processed food.” Other provisions backed by ENVI would require (i)…

While the city of Zurich reportedly employs a lawyer to represent animals in cases alleging abuse or excessive cruelty to animals, Swiss voters have overwhelmingly rejected a measure that would have expanded the practice throughout the country. Some 70.5 percent of the electorate defeated a proposal that would have required paying 25 or more lawyers to prosecute humans on behalf of abused animals. Some have attributed the outcome to recent press reports that Zurich’s animal advocate was involved in prosecuting an angler who boasted that it took him some time to reel in a 22-pound pike. The angler was charged with and prosecuted for causing excessive suffering to the animal, but later acquitted. Although the pike story attracted numerous animal rights fans, many Swiss apparently did not believe that fish need legal representation.
