Several members of Congress, led by Reps. Ileana Ros-Lehtinen (RFla.) and Debbie Wasserman Schultz (DFla.), have urged Secretary of State Rex Tillerson and Secretary of the Treasury Steven Mnuchin to review the Office of Foreign Assets Control's (OFAC's) "unprecedented decision to grant a license to allow Cubaexport, an entity whollyowned by the Cuban government, to renew an expired trademark registration for Havana Club rum in the United States." The lawmakers express concern about the implications for American intellectual property rights holders because "Cubaexport claims rights to the Havana Club registration through its confiscation, without compensation, of the Jose Arechabala Company" in 1960. The White House has issued a policy directive intended to promote “authorized engagements with Cuba to advance cooperation on areas of mutual interest, and increase travel to, commerce with, and the free flow of information to Cuba.” To this end, the Department of the Treasury’s Office of Foreign Assets Control (OFAC) and the Department of Commerce’s Bureau of Industry and Security have announced amendments to the Cuban Assets Control Regulations and Export Administration Regulations that will lift restrictions on travelers bringing Cuba-origin alcohol, cigars and other products back to the United States for personal use. Bacardi Ltd. has reportedly filed a Freedom of Information Act request seeking information on the renewal of a trademark registration for “Havana Club” granted to Empresa Cubana Exportadora de Alimentos y Productos Varios (“Cubaexport”), a Cuban government-owned entity. Cubaexport had filed for a renewal in 2006, but the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) refused to grant the license required to renew the trademark. Cubaexport sold its rum recipe and the rights to “Havana Club” to Bacardi in 1994, 30 years after the United States prohibited the import of Cuban goods. Bacardi sold rum under the “Havana Club” name while disputing the rights to the mark with Pernod Ricard, which owns the rights to sell Havana Club worldwide.
