A study examining the health effects of soft drink consumption in 10 European countries reportedly found that both sugar-sweetened and artificially sweetened beverages are associated with greater all-cause mortality. The researchers assessed dietary intake of 451,743 participants and apparently found a correlation between consuming two or more soft drinks per day and higher rates of mortality from circulatory, digestive and neurodegenerative diseases.

The U.S. Court of Appeals for the Second Circuit has denied a plaintiff's appeal aiming to overturn a lower court's dismissal of a lawsuit alleging that Diet Dr Pepper is misleadingly named because it does not cause weight loss. Excevarria v. Dr Pepper Snapple Grp., Inc., No. 18-1492 (2nd Cir., entered April 17, 2019). A federal court in New York has dismissed with prejudice a putative class action alleging that Pepsi-Cola Co. falsely and deceptively used the term "diet" for its Diet Pepsi, leading consumers to believe that the beverage would help them lose weight or assist with "healthy weight management." Manuel v. Pepsi-Cola Co., No. 17-7955 (S.D.N.Y., entered May 17, 2018). Following three federal district court dismissals of nearly identical claims, the court found that "no reasonable consumer would understand a soft drink labeled as 'diet' to be a weight-loss product." "'Diet' immediately precedes 'Pepsi,' and thereby connotes a relative health claim—that Diet Pepsi assists in weight management relative to regular Pepsi," the court held. Although "diet" is used to identify other weight-loss products, "in the context of soft drinks, the term unambiguously signals reduced calorie content relative to the non-diet version of the drink in question." A recent study has allegedly linked diet soft drink consumption with an increased risk of vascular events. Researchers evidently collected data from 2,564 adults in the Northern Manhattan Study for a mean follow-up of 10 years, controlling for a variety of factors such as age, race/ethnicity, smoking, BMI, and physical activity. Compared with those who did not consume diet soft drinks, participants who reported drinking diet soft drinks on a daily basis apparently exhibited “an increased risk of vascular events, and this persisted after controlling further for the metabolic syndrome, peripheral vascular disease, diabetes, cardiac disease, hypertension, and hypercholesterolemia.” The study authors noted, however, that many individuals “may consume diet soft drinks in an effort to reduce calories and sugar…

U.K. researchers have reportedly linked sugar-sweetened beverages to a risk of high blood pressure, speculating that “one possible mechanism” for the association “is a resultant increase in the level of uric acid in the blood that may in turn lower the nitric oxide required to keep the blood vessels dilated.” Ian Brown, et al., “Sugar-Sweetened Beverage, Sugar Intake of Individuals, and Their Blood Pressure: International Study of Macro/Micronutrients and Blood Pressure,” Hypertension, February 2011. “Diet soda isn’t as addictive as drugs like nicotine, but something about it seems to make some people psychologically—and even physically—dependent on it,” opens this Health.com article on individuals who drink more than the average amount of diet soda per day. According to journalist Denise Mann, some diet soft drink aficionados imbibe anywhere from four cans to 2 liters every day, raising questions for medical professionals about whether these consumers are “true addicts.” The article cites self-reported “addicts” as well as researchers claiming, for instance, that some diet soda drinkers are simply swapping one compulsive behavior for another, or conditioning themselves to crave diet soft drinks while performing certain activities. A study presented at the American Stroke Association’s International Stroke Conference 2011 has reportedly linked daily diet soda consumption “to a higher risk of stroke, heart attack and vascular-related deaths.” Led by University of Miami scientist Hannah Gardener, researchers analyzed soft drink consumption for 2,564 people enrolled in the Northern Manhattan Study (NOMAS), grouping participants into seven categories ranging from those who drank less than one soda of any kind per month, to those who reported daily regular or diet soda consumption.
